Can a Police Officer Force Me to Take a Sobriety Test?
The answer to this question varies. In most cases, the answer is no. A police officer usually cannot force a driver to take a sobriety test, whether that is a breathalyzer test, field sobriety test, or blood or urine test. This, however, is not always the case.
On “no refusal” weekends, a police officer has the authority to force an individual consent to a sobriety test. Most commonly, an individual will be forced to take a blood test. Though this is a controversial act, it has been legally recognized, but only on “no refusal” weekends.
